Terms and Conditions

Last updated: October 2026

These terms apply to all work Tomcy Agency carries out for clients in the UK, Mallorca and elsewhere. Tomcy Agency is a creative content studio founded by Tom Ansell. By accepting a quote or booking our services, you agree to these terms. If your quote or a separate written agreement says something different, the quote or agreement takes priority.

1. About us

Tomcy Agency. Company registration number: [Company registration number]. Registered address: [Registered address]. Website: www.tomcy.agency. Email: Tom@tomcyagency.com or hello@tomcyagency.com. Phone and WhatsApp: +44 7891 946305.

2. Our services

We provide cinematic video, photography, reels and social content, branding and web design, and Meta ad management. The exact scope of each project is set out in your quote.

3. Bookings and quotes

Quotes are valid for 30 days from the date they are issued. Your booking is confirmed only once you accept the quote in writing (email is fine) and pay any deposit due. Work outside the agreed scope will be quoted separately before we go ahead. Prices exclude VAT and other applicable taxes unless your quote says otherwise.

4. Deposits and payment

A deposit, as stated in your quote, is due to secure your booking. Dates are not held until the deposit is received. The balance is due as stated in your quote or invoice. For ongoing work, such as monthly retainers, invoices are issued and payable as set out in your quote. If a payment is late, we may pause work and hold back deliverables until your account is up to date, and we may charge interest on late payments where the law allows.

5. Cancellation and rescheduling

If you need to cancel or move a booking, please tell us in writing as early as possible. Your deposit secures the date and covers planning time, so it is non-refundable if you cancel, unless your quote says otherwise. Any other cancellation charges will be as stated in your quote. If you need to reschedule, we will do our best to find a new date that suits you, subject to availability. Costs we have already committed to on your behalf (such as travel, crew, equipment or location hire) may be charged. If we have to cancel for reasons within our control, we will offer you a new date or refund any money paid for work not yet carried out.

6. Your responsibilities

You are responsible for:

  • giving us access to the locations, venues, people and information we need, at the agreed times
  • getting any permissions needed to film or photograph at locations you choose, for example from venues, landlords or local authorities
  • making sure everyone featured in the content (staff, guests, models and talent) has agreed to be filmed or photographed and has signed any release needed (we can provide a release form on request)
  • making sure any material you give us (logos, music, images and text) belongs to you or is properly licensed
  • giving clear and timely feedback and approvals

Delays caused by missing access, permissions or feedback may affect timelines and may be charged.

7. Deliverables and revisions

Your deliverables (for example the number of edits, photos, formats and lengths) are as set out in your quote. Your fee includes the number of revision rounds stated in your quote. A revision round is one combined set of feedback on a draft. Extra revisions, or changes to the agreed brief after work has started, may be charged. Final files are delivered digitally, usually by download link or through our client portal. Please download and back up your files promptly. We keep copies for a reasonable period, but we are not an archive service.

8. Turnaround times

We will give you an estimated delivery time when we confirm your booking. Turnaround times are estimates, not guarantees, and depend on timely feedback, approvals and any materials we need from you. We will keep you updated if anything changes.

9. Usage rights and licensing

Tomcy Agency keeps the copyright in all photos, footage, designs and other work we create. Once you have paid in full, you receive a licence to use the final deliverables for the purposes agreed in your quote, or, if none are stated, to promote your own business. No licence is granted until full payment is received. You may not resell or sublicense the work, or claim it as your own, without our written agreement. We may use the work in our portfolio, website, social media and showreels, unless we agree otherwise in writing (for example, for confidential projects).

10. Raw footage and unedited files

Raw footage, unedited photos and working files are not included unless agreed in your quote. If you would like them, just ask and we will quote for them.

11. Drone work

Drone filming is always subject to the weather and to legal flight restrictions, including airspace rules, permits and local regulations in the UK and Spain. Our pilot has the final say on whether it is safe and legal to fly. If drone work cannot go ahead, we will reschedule or agree an alternative with you.

12. Ad management

Our Meta ad management fee covers the strategy, setup, creative and management set out in your quote. Ad spend is paid by you, directly to Meta or the relevant platform, and is separate from our fee. Advertising results depend on many factors outside our control, so we cannot guarantee specific results such as leads, sales, reach or return on ad spend. You are responsible for making sure your offers, landing pages and business comply with platform policies and the law.

13. Websites

Our web design fee covers the design and build set out in your quote. Hosting, domain names, paid plugins, software subscriptions and other third-party costs are not included unless your quote says so, and are paid by you. You are responsible for supplying your content (such as text, images and product information) on time, for having the right to use it, and for its accuracy. We are not responsible for outages or changes caused by third-party hosting or platform providers.

14. Weather and events outside our control

Outdoor shoots depend on the weather. If conditions make a shoot unsafe or unsuitable, we will agree a new date with you. We are not liable for delays or for being unable to carry out work because of events outside our reasonable control (force majeure), such as extreme weather, illness or injury, travel disruption, strikes, natural events or government restrictions. In these cases we will reschedule where possible, or refund any money paid for work not carried out.

15. Our liability

We take great care with every project. Our total liability to you for any project is limited to the fees you have paid for that project. We are not liable for indirect or consequential losses, such as loss of profit, business or opportunity. Nothing in these terms limits our liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law. If you are a consumer, these terms do not affect your statutory rights.

16. Complaints

If you are unhappy with any part of our work, please tell us as soon as possible by emailing Tom@tomcyagency.com. We will acknowledge your complaint and aim to resolve it quickly and fairly.

17. Changes to these terms

We may update these terms from time to time. The version in force when you accept your quote applies to your project.

18. Governing law

These terms are governed by the law of [Governing law], and any disputes will be dealt with by the courts of [Jurisdiction for disputes].
